Terms and conditions

  1. We are Think Ahead Education Solutions Proprietary Limited with Registration Number 1998/011450/07. We are a private company registered and incorporated in the Republic of South Africa.
  2. IF YOU ARE YOUNGER THAN EIGHTEEN (18), PLEASE READ THESE TERMS AND CONDITIONS WITH YOUR PARENT OR LEGAL GUARDIAN. YOU MUST HAVE PERMISSION FROM YOUR PARENT OR LEGAL GUARDIAN BEFORE REGISTERING WITH US ON OUR PRESS TEAM PLATFORM. BY READING FURTHER AND/OR BY REGISTERING YOU PROMISE AND AGREE THAT YOU ARE EITHER OLDER THAN EIGHTEEN (18) OR THAT YOU HAVE YOUR PARENT’S PERMISSION.
  3. We recommend that parents and legal guardians, who allow their children to use the iSchool Press Team platform (“the Press Team platform”), first discuss online safety with their children and then continue to monitor all use of the Press Team platform.
  4. THESE TERMS AND CONDITIONS ARE BINDING AND ENFORCEABLE AGAINST ALL PERSONS THAT ACCESS AND USE THE PRESS TEAM PLATFORM. BY ACCESSING THE PRESS TEAM PLATFORM YOU ARE AGREEING TO THE TERMS AND CONDITIONS SET OUT ON THIS PAGE. THESE TERMS AND CONDITIONS GOVERN YOUR USE OF THE PRESS TEAM PLATFORM AS WELL AS YOUR RESPONSIBILITIES AND ALSO OURS. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE PRESS TEAM PLATFORM. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, THEN PLEASE IMMEDIATELY CEASE ALL USE OF AND ACCESS TO THE PRESS TEAM PLATFORM, AND PLEASE LEAVE THE PRESS TEAM PLATFORM IMMEDIATELY AS FURTHER USE OF AND ACCESS TO THE PRESS TEAM PLATFORM WILL AUTOMATICALLY BIND YOU TO THESE TERMS AND CONDITIONS.
  5. The views and opinions expressed by any individual within the Press Team platform belong to that individual only and do not necessarily reflect our views or opinions.
  6. Any advice or information posted to the Press Team platform should not just be accepted as true or correct. It is up to you to check the truthfulness of any advice or information before relying on it, especially where the consequences of relying on such advice or information could be harmful.
  7. The Press Team platform and membership are only intended for use by students who are in senior primary or high school levels.
  8. You agree that you will NOT:
    1. make use of any contact details of fellow Press Team members for commercial reasons or for any reason at all without first receiving permission in writing from that member;
    2. provide us with any false personal information;
    3. register for anyone other than yourself;
    4. create more than one personal account. If we disable your account, you may not create another one without first receiving our written permission;
    5. share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might put at risk the security of your account;
    6. transfer your account (including any Page or application you administer) to anyone without first receiving our written permission;
    7. falsely represent any relationship that you may have with us to any other person or falsely claim that you have an association or relationship with us;
    8. do anything that could disable, overburden, or impair the proper operation or appearance of the Press Team platform, such as a denial of service attack or interference with page rendering or other Press Team functionality.
  9. You are responsible for maintaining the confidentiality of your account, user name and password and for restricting access to your computer and you agree to accept responsibility for all activities that occur in the name of your account, user name and password.
  10. You agree to keep your contact and personal information accurate and up-to-date at all times.
  11. We have the right to immediately, and without telling you first, refuse you access to the Press Team platform, cancel your account and/or remove or edit your contributions to the Press Team platform should you fail to comply with any of these terms and conditions. We also reserve all of our rights to take any and all other legal steps available to us.
  12. In order to keep the Press Team platform honest, compassionate, respectful and fair to everyone you agree that your use of the Press Team platform and your contributions must:
    1. be true, accurate and a genuine representation of your views, beliefs and/or opinions;
    2. avoid quoting out of context;
    3. include a credit for the original author of any source of material that you use;
    4. comply with all applicable local, foreign and international laws that govern the content which makes up your contribution;
    5. be in accordance with these terms and conditions.
  13. You also agree that your use of the Press Team platform and your contributions will NOT:
    1. be defamatory, unlawful, obscene, offensive, hateful, abusive, inflammatory, discriminatory, threatening, invasive of anyone’s privacy, or otherwise objectionable;
    2. promote discrimination on grounds of race, sex, religion, nationality, ethnicity, disability, religion or belief, sexual orientation, being a transsexual person, or age;
    3. infringe upon any intellectual property rights including copyright, design rights, database rights, patents, trademarks, moral or performer’s rights or any other third party rights;
    4. harass, bully, upset, alarm or cause distress to any other person;
    5. contain an instruction, advice, or content that could cause harm or injury to individuals or to computers or other systems;
    6. encourage or incite anyone to commit any unlawful or criminal act or condone any unlawful or criminal act;
    7. give the impression that your contribution stems from us (or any of our sponsors, partners or affiliates);
    8. impersonate any person or misrepresent your identity or affiliation with any person;
    9. contain any advertising, show third party adverts or web search boxes on the Press Team platform;
    10. have viruses or any other malicious code;
    11. contain nudity or graphic or gratuitous violence.
  14. You promise and agree that:
    1. before submitting a contribution to the Press Team platform, you will first receive written permission from the true owner of any image or visual that you use in your contribution (or that person’s parent or other legal guardian), allowing you to use their image or visual in your contribution and also allowing you to submit their image or visual to the Press Team platform, as per the indemnity form which you must download from ischoolpressteam.co.za and have completed and signed;
    2. before submitting a contribution to the Press Team platform, you will first receive written permission from any individual that you photograph or record and which photographs or recordings you choose to use in your contribution (or that person’s parent or other legal guardian), allowing you to make that photograph or recording, use it in your contribution and also allowing you to submit that photograph or recording to the Press Team platform, as per the indemnity form which you must download here www.ischoolafrica.com/youthpressteam and have completed and signed;
    3. we have the right to disclose your full names and contact details to any third party that provides a reasonable claim that any contribution submitted by you to the Press Team platform is defamatory of them, a violation of their intellectual property rights, or of their right to privacy. Any communication released by us in this regard will be sent to you too using the contact details provided by you;
    4. we may use any contribution submitted by you to the Press Team platform for marketing purposes or for any other purpose that may benefit or profit us.
  15. Neither we nor our directors, members, partners, contractors, employees or affiliates will be held responsible for the negligent or unauthorised use of any contribution submitted by you to the Press Team platform and you are solely responsible for your contribution.
  16. If you repeatedly infringe or violate any intellectual property rights, whether belonging to us or any third party, we will disable your account.
  17. If we fail to enforce or apply any of these terms and conditions, we will not lose our right to do so at any other time..
  18. By submitting a contribution to the Press Team platform, you promise and agree that:
    1. you grant to us an exclusive perpetual license to use that contribution;
    2. we will have the right to freely use, edit, alter, reproduce, publish and/or distribute your contribution and the material contained in your contribution in any format or media and for any purpose or reason at all;
    3. the license will be free of charge, perpetual and capable of sub-license to a third party;
    4. we reserve the right to display advertisements in connection with your contribution;
    5. the license includes the resale or commercial use of your contribution;
    6. the content of your contribution may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited by us for any commercial purpose or used by us in any other way which will profit us, without first receiving your written permission;
    7. we may access, display, use, download, and/or otherwise copy or distribute your contribution or any of the content, data or information available in or through your contribution for marketing or other purposes without first obtaining your written permission;
    8. your contribution does not infringe any copyright, database right, intellectual property rights, trademark or any other rights of any other person and you have the right to grant to us the license. IF YOU CANNOT GRANT THE LICENSE TO US, PLEASE DO NOT SUBMIT YOUR CONTRIBUTION TO THE PRESS TEAM PLATFORM.
  19. We, and our directors, partners, officers, employees, contractors, agents, licensors, successors, assigns and affiliates expressly state that we do not:
    1. have any liability to you, other users of the Press Team platform or any other person for any loss, injury, expense, damage (whether direct, indirect, incidental [minor or secondary], punitive [as a punishment] or consequential [damages which follow as a result of]) loss of profits, loss of goodwill, loss of the use of, or the inability to use the Press Team platform or other intangible losses (even if we have been advised of the possibility of such damages) resulting from any data, information, software or messages provided directly or indirectly by us or the Press Team platform or from any other cause at all;
    2. give any warranties or promises, whether express or implied, that the Press Team platform is free of worms, trojans, bombs, or any other viruses or codes which can harm, corrupt or affect the operation of your system; or that the Press Team platform is free from errors or omissions. We further expressly state that we do not have any liability to you for any damage at all that you may suffer as a result of any such worms, trojans, bombs, or any other viruses or codes or any errors or omissions;
    3. have any liability arising from unauthorised access to or alteration of the transmissions or content provided by us or through the Press Team platform.
  20. We agree to take all reasonable steps to protect your personal information. We agree that any information received from you will not be released to any other person unless you have first provided us with your written permission or unless we are required to do so in terms of the laws of the Republic of South Africa or any other law to which we may be subject or unless it is in terms of 14.3 above.
  21. You agree that we may electronically collect, collate, process, store and use your following personal information:
    1. name and surname;
    2. contact numbers and other contact details;
    3. non-personal browsing habits and click patterns; and
    4. IP address.
  22. We confirm that we collect, store and use your above-mentioned information to:
    1. communicate information to you as requested by you;
    2. provide you with access to restricted pages on the Press Team platform;
    3. compile non-personal, general statistical information regarding browsing habits, click patterns and access to the Press Team platform.
  23. Where the information is not collected from you directly, we collect the information electronically by using cookies. You can change your browser settings in order to determine and control the usage and accessibility of cookies.
  24. You agree that we are entitled to compile, use and share any information that does not specifically relate to you or any other specific individual.
  25. By visiting the Press Team platform, submitting contributions and/or by sending emails to us, you agree to receiving communications from us electronically and you further agree that all agreements, notices, disclosures and any other communications sent by us satisfy any legal requirements, including but not limited to, the requirement that such communications should be in writing.
  26. You hereby agree that we may communicate with you directly for marketing purposes or for any other purpose. Please note that you have the right to refuse this condition by sending us an email to youthpressteam@ischoolafrica.com.
  27. You agree that we have the right to change any of these terms and conditions and the right to choose whether or not to make any changes and you agree that we do not need to notify you before making any changes. Your continued use of the Press Team platform following any change shall confirm your agreement with the terms and conditions, however they may have been changed. You are expected to read this page from time to time and to take notice of any changes we make, as they are legally binding on you and will apply to you from the date the change was made.
  28. If you wish to complain about any contribution posted to the Press Team platform, please contact us at ypt@ischoolafrica.com. When you submit a complaint, please (1) outline the reason for your complaint, and (2) specify where the contribution you are complaining about is located.
  29. We may request further information from you about your complaint before we process it. We will then review the contribution and decide whether it complies with our standards. We will inform you of the outcome of our review within a reasonable time of receiving your complaint.
